Our public hospital admits outpatient blood transfusion patients solely to attract ABF funding. There is usually no clinical need for admission. Is this legal?

Context

In our public hospital outpatient department, patients may elected to be seen as PRNI (Privately Referred Non-Insured) and the clinic visit is billed to Medicare. On the same day they will move to the adjacent therapeutic centre for a procedure (also PRNI) and sometimes a blood transfusion. However when (both) occur, the hospital administration has decided to make the blood transfusion event an inpatient episode of care, as it attracts significant ABF Funding. Is this legal?
