Can Medicare be charged by a pathology company if the request was signed by a doctor who did not see the patient and is not going to view or interpret the results?

Context

Can Medicare be charged by a pathology provider if the pathology request came from a doctor who has no intention of viewing the results. An online vendor issues the request and charges a fee for providing it - but does not bill it to Medicare.

The telehealth company disclaimer says:
By proceeding with this service, you acknowledge and agree that:

[redacted] Doctors’ role is limited to issuing a pathology referral [sic: request] and providing results.

[redacted] Doctors do not interpret or diagnose pathology results.

You must consult your regular GP for review and discussion of all results (normal or abnormal).

You will seek immediate medical care for any urgent or abnormal findings or symptoms.

You accept that failure to follow up abnormal results may result in health risks.

You remain responsible for arranging ongoing care and management.

This online provider charges $49 which is described as covering administrative and issuing costs of the referral [sic: request]. Refunds are not available and the terms state that pathology providers may bulk-bill Medicare or charge additional fees if tests are non-rebatable.
